iCruise Terms & Conditions
General:
All bookings are in NZ$ based on per person twin share accommodation,
unless otherwise stated. All fares are subject to change
without notice due to currency fluctuations and availability
restrictions. Specific cabin allocation is subject to the
respective cruise line's discretion, unless otherwise pre-arranged
at time of booking. Fares are based on standard inside, outside & balcony
cabin and suite accommodation categories and include port
taxes and government fees.
Guarantees:
A guarantee is the "Cruise Lines" undertaking to provide
a specific type of cabin and fare. A cabin number however,
will be advised at a later date and the "Cruise Line" has
the right to change the cabin allocated at their discretion.
Changes to Reservations:
"Cruise Lines" charge for amendments to deposited and/or
paid reservations. These fees vary depending on the cruise
line, the itinerary, the destination, and/or nature of the
amendment. iCruise impose an amendment fee of NZ$15.00 per
person per amendment once the booking has been paid and/or
deposited. These fees are in addition to any fees imposed
by the cruise line.
Making Your Own Travel Arrangements:
When making your own arrangements pre and post cruise, whether
it be via a travel agent or other party, please ensure you
arrive no later than midday on the day your cruise departs,
and your return arrangements no earlier than midday on the
day your cruise arrives. iCruise will not
be held responsible for any unforeseen circumstances that
necessitate any changes to your travel arrangements.
It is a requirement by the cruise line that you advise your pre & post
cruise travel arrangements, please advise your iCruise consultant of your
flight itinerary and pre & post cruise arrangements at time of booking.
Illicit Substances:
A cruise line reserves the right to search your person and/or
luggage for any illicit substances. Cruise lines also reserve
the right to deny boarding or disembark any persons in possession
of illicit substances. Please refer to the cruise line’s
Terms & Conditions pages in their brochure.
Alcohol:
Cruise lines conditions to whether passengers can embark
with alcohol or not vary per cruise line. The cruise line
has the right to confiscate alcohol and return it on disembarkation.
The respective country's customs regulations do apply. Please
ask your iCruise consultant for details relating to your
cruise or refer to the cruise line's Terms & Conditions
pages in their brochure.
Smoking:
In the interests of passenger comfort, ships have designated
smoking areas. Few ships offer a completely non-smoking policy.
Fares:
The cruise fare is determined by the number of passengers
in a cabin, its location on the ship and the type of amenities
offered. Your "total fare" (to which cancellation fees are
applied) includes the cruise fare, any applicable discount,
charges, government taxes & fees, any tour/land/air components
which are correct at the time of publication. All fares are
subject to change without notice. Additional information
such as itineraries, ports of call are subject to change
without notice. Please ask your iCuise consultant for up
to date information or refer to the cruise line's Terms & Conditions
pages in their brochure.
Promotional Fares:
On occasions cruise lines release "Promotional Fares", the
respective cruise line can release and withdraw these fares
at any time without notice. Promotional Fares are applicable
to new bookings only and may contain strict conditions. Promotional
fares are generally berthed at the cruise lines discretion
(guarantee) and no specific cabins numbers will be allocated
at the time of booking. Cabin numbers will be allocated at
the
time
of
embarkation and the cruise line reserves the right to change
the allocated cabin at any time.
Your Fare Includes:
Transportation for the cruise duration, accommodation in
your selected cabin/stateroom, all main meals, onboard entertainment
and activities, applicable port taxes/fees.
Some inclusions vary per cruise line & package you may have purchased,
please re-confirm your inclusions with your iCruise consultant.
Not Included in Your Fare:
Items of a personal nature, shore excursions, beverages
(other than filter coffee/tea & water), gratuities, meals
ashore, casino, health & spa facilities, internet access,
laundry services, ship's photography, bingo, merchandise
from the ship's shopping outlets, onboard telephone & fax
facilities.
Items not included in your fare may vary per ship & cruise line, please
ask your iCruise consultant for details relating to your cruise or refer
to the cruise line's Terms & Conditions pages in their brochure.
Single Occupancy:
You may enjoy the exclusive occupancy of a twin cabin. Single
occupancy cabin prices are on request.
Responsibility:
1. The guarantees under the Consumer's Guarantee Act 1993
will apply to services supplied by us except where they are
acquired, or are held out as being acquired, for business
purposes.
1.1 The services that Adventure International Ltd. Trading as iCruise,
supply consist of arranging and co-ordinating travel, entertainment and
accommodation facilities and services and making bookings, issuing tickets
and vouchers to be redeemed by Suppliers. We will not be liable for any
loss or damage of any kind (direct, indirect, consequential or otherwise)
which you may suffer resulting from our selection of those suppliers, or
your use or consumption of, or inability to use or consume those facilities
or services*.
1.2 We undertake to perform these services with reasonable care and skill.
We will not be liable for any loss or damage which results from the act,
default or omission of any person other than ourselves, our employees or
agents, or any cause independent of human control. This includes (but is
not limited to), loss or damage which arises, directly or indirectly from
any act of God, weather disruptions, dangers incidental to the sea, fire,
breakdown in machinery or equipment, acts of Government or other authorities
de jure or de facto, wars whether declared or not, hostilities, civil disturbances,
strikes, riots, pilferage, quarantines or
medical or customs regulations.
1.3 We are not able to exercise control over services we do not supply
directly, therefore we will not be responsible for any loss or damage arising
from:
- Any booking made directly with a service Supplier by your travel agent
or;
- Any services that are not provided by us and which are additional to
those described in the iCruise website.
1.4 We will endeavour to provide the most suitable travel arrangements
to meet the particular requirements you have made known to us. However,
travel is an individual experience and your preferences and opinions may
vary from our own. For this reason, we cannot take responsibility for your
individual satisfaction.
Supply of Travel, Entertainment, Accommodation Services & Facilities:
2.1 When we make your bookings with the Suppliers of travel,
entertainment and accommodation facilities or services, we
are acting as a booking agent for the Suppliers.
2.2 All travel, entertainment and accommodation facilities or services
are supplied directly to you by the Suppliers. We have no control over
the facilities or services themselves, or the manner in which they are
provided by the Suppliers. Therefore you should be aware of the following
conditions:
- We will not be liable for any loss or damage of any kind which may arise
from your use or consumption of, or any inability to use or consume those
facilities or services.
- The provision of those facilities and services is subject to those terms
and conditions of your contract with each Supplier.
- Where for any reason a Supplier is unable to provide particular facilities
or services, then that Supplier may be entitled, under its contract with
you to substitute those services or facilities with comparable services
without incurring any liability to you. You should check your contract
with each Supplier.
- All facilities or services described by us are subject to availability
from the Supplier.
- We will not be liable or responsible for any loss or damage relating
to your baggage, personal possessions, health or welfare, or delays or
travel disruptions, unless these arise directly from the service we provide
to you.
Business Purposes:
3.1 You agree that where our services are acquired for business
purposes, or where you hold yourself out as acquiring our
services for business purposes, the Consumer’s Guarantee
Act 1993 will not apply to any supply of goods or services
made under these conditions and we will not be liable or
responsible for any loss or damage of any kind to you, including
any consequential loss or damage however it may be caused.
Information in this Website:
4.1 This website is valid and we endeavour to update information
as and when required. Prices quoted on this website are based
the current exchange rate.
4.2 While we have exercised reasonable care and skill to ensure the contents
of this website are correct, accurate, and up-to-date at the time of production,
please note that the contents of this website are based on information
supplied to us by the Suppliers. We do not have and cannot be reasonably
expected to have, personal knowledge about all of the facilities or services
provided by each Supplier.
4.3 Facilities and services may change after the date of production. We
endeavour to keep clients informed of any changes to information in this
website which are brought to our attention. Prior to booking, you should
ask your iCruise consultant about any changes to the published information
of which iCruise may be aware. You should also make sure that if your iCruise
consultant is advised of changes that occur after booking, your iCruise
consultant is able to contact you.
4.4 All maps, illustrations and photographs are for indicative purposes
only and may not necessarily reflect actual places, positioning, vessels
or exact itineraries.
Prices:
5.1 Unless otherwise specified, all prices in this website
are on a per person/twin share basis and are expressed in
New Zealand dollars.
5.2 Events beyond our control, such as currency fluctuations, changes to
the price of world fuel or changes to the cost of services and facilities
may result in the prices charged to you being different to those shown
in the website. You should check all prices with your iCruise consultant
before making reservations and before making final payment.
5.3 Prices may also be liable to variation between the time of booking
and departure. We reserve the right to vary the price up until the time
of your final payment being received by us.
5.4 The air content of fly/cruise packages are applicable at the time of
production. As airline costs are constantly changing it may be necessary
to impose an air surcharge at any time up until departure.
5.5 Receipt of a deposit will be taken as an understanding by iCruise that
the participant had read and agrees to abide by these terms and conditions.
Legal Claims:
Any claims or legal action in connection with the provision
of our services to you will be governed by the laws of New
Zealand. Any claim or legal action against the Suppliers
is likely to be subject to the terms of your contract with
them, and may be governed by the laws of other countries.
